(a) This section will take effect immediately throughout the entire State.
(b) The remaining provisions of this Act will take effect immediately in the districts of East Godavari, West Godavari, Krishna, Guntur, Kurnool, Anantapur, Cuddapah, and Nellore.
(c) The State Government may, through a notification in the [Telangana Gazette], extend the application of the remaining provisions of this Act to additional areas within the State, effective from a date specified in the notification.

Constitution of Home Guards and appointment of officers 2025

The State Government has the authority to establish a volunteer organization known as the “Home Guards” for each of the regions identified in section 1 (3) (b) and for any additional areas designated under section 1 (3) (c). Each member of this organization will possess specific powers and responsibilities related to the protection of individuals, the safeguarding of property, and the maintenance of public order or peace, as assigned by this Act.

Furthermore, the State Government, or any individual authorized by them, may appoint a sufficient number of officers deemed necessary for the effective management and operation of the Home Guards. Among these appointed officers, one may serve as the Commandant overseeing all Home Guards within the State.

Appointment and Removal of Telangana Home Guards 2025

(1) In accordance with the provisions of this Act and the associated regulations, any individual who meets the specified qualifications and is willing to serve may be appointed as a Home Guard by the designated authority and in the manner outlined in the regulations.
(2) Each Home Guard shall be issued a certificate of appointment, which will be in a specified format and provided by the designated authority, granting them the powers, privileges, and protections, as well as the responsibilities assigned to a Home Guard under this Act.
(3) The designated authority may, in accordance with the established conditions, suspend, dismiss, or remove any Home Guard from their position; consequently, the certificate they received will no longer be valid.

Telangana Period of Service and Discharge 2025

A Home Guard is required to serve the State Government for a specified duration and in designated areas as determined by regulations. However, they may be released at any time by the appropriate authority, in accordance with the established conditions.

Calling out of Home Guards 2025

The Commissioner of Police for the Cities of Hyderabad and Secunderabad, along with the District Superintendent of Police for the relevant district, has the authority to summon any Home Guard for the specified cities or district, as applicable, at any time. This can be done in a manner and through an officer as designated, for the purpose of training or fulfilling any responsibilities assigned to them under this Act.

Powers, Privileges and Protection of Home Guards 2025

  1. A Home Guard, when summoned under section 6, shall possess the same authority, privileges, and protections as a police officer appointed under either the Hyderabad City Police Act (Act IX of 1348 F) or the Andhra Pradesh (Andhra Area) District Police Act of 1859, depending on the relevant context.
  2. No legal action shall be initiated against a Home Guard for any actions taken or purportedly taken in the execution of his powers or duties, unless prior approval has been obtained from the Commissioner of Police in the Cities of Hyderabad and Secunderabad, or from the District Superintendent of Police in the respective district.

Penalties for Telangana Home Guard 2025

  1. Any Home Guard who, without justifiable reason, fails to comply with the directives of a superior authority or officer, neglects to fulfill any other duty, abandons their post, or commits a deliberate violation or neglect of any provision of this Act or any rules or lawful orders issued by a competent authority, shall be subject to punishment of simple imprisonment for a duration of up to three months, a fine of up to two hundred and fifty rupees, or both.
  2. No legal action shall be initiated against any Home Guard for an offense described in subsection (1) without prior approval from an officer designated by the State Government for this purpose.
  3. An offense outlined in subsection (1) shall be classified as cognizable.
