Constitution of Home Guards and Appointment in Kerala 2024

  • The Government has the authority to establish a volunteer organization known as the “Home Guards.”
  • The members of this organization will perform various functions and responsibilities related to the protection of individuals, the safeguarding of property, and the maintenance of public safety, as assigned to them in accordance with this Act and the associated regulations.
  • The Government may designate one or more Commandants to oversee the Home Guards established under subsection (1).
  • Additionally, the Government may appoint a Commandant-General for the Home Guards, who will be responsible for the overall supervision and management of the Home Guards within the State.

A member of the Home Guards has the option to resign from their membership by providing a minimum of one month’s notice to the Commandant under whose jurisdiction they are currently serving, should they choose to do so.

Punishment for Neglect Duties 2025

(1) The Commandant has the authority to suspend, reduce, dismiss, or impose a fine of up to fifty rupees on any member of the Home Guards under his supervision if that member fails to fulfill his responsibilities or refuses to comply with any lawful orders or directives related to his duties. Additionally, if a member is found guilty of any disciplinary violations or misconduct, the Commandant may take similar actions. The Commandant-General possesses the same powers regarding any member of the Home Guards appointed to a position under his authority and may also dismiss a member based on conduct that has resulted in a criminal conviction.

(2) Notwithstanding any provisions in this Act, the Commandant is empowered to discharge any member of the Home Guards at any time, subject to prescribed conditions, if he deems that the services of that member are no longer necessary. The Commandant-General holds the same authority concerning any member of the Home Guards appointed to a position under his command.

(3) When the Commandant-General or the Commandant issues an order to suspend, reduce, dismiss, or fine a member of the Home Guards as outlined in this section, they must document the order along with the reasons for it and a record of the inquiry conducted. Furthermore, no such order shall be issued without providing the individual in question an opportunity to present their defense.

  1. Should any member of the Home Guards, when summoned under section 5, fail to comply with such an order without a valid excuse, or neglect to fulfill his duties as a member of the Home Guards, or disregard any lawful instruction given for the execution of his responsibilities, he shall be subject to punishment upon conviction. This may include simple imprisonment for a duration of up to three months, a fine not exceeding two hundred and fifty rupees, or both penalties.
  2. If a member of the Home Guards intentionally fails or refuses to return his certificate of appointment or any other item as stipulated in subsection (1) of section 9, he shall face punishment upon conviction. This may involve imprisonment for a period of up to one month, a fine not exceeding one hundred rupees, or both.
  3. No legal action shall be initiated under subsection (1) or subsection (2) without prior approval from the Commandant.
  4. A Police Officer is authorized to arrest, without a warrant, any individual who commits an offense punishable under this section.
